Britain's PM eats humble pie over snack tax

In days gone, pasties were the food of miners and farmers -- a robust parcel that (so legend has it) could be dropped steaming hot down a mine shaft or thrown over a high hedge to the agricultural laborers on the other side.

LONDON -- We're a placid bunch, us Brits.

You can call us names and poke us in the eye and we'll pretty much stand there and take it.

So pity the poor misguided chaps who run this country and who decided to try their luck by introducing a tax on ... pasties.

Man the barricades!


For those who are not among the cognoscenti, a pasty is a traditional and tasty food that resembles a meat and potato pie. It has almost iconic status in its place of origin, the distant and beautiful county of Cornwall.

In days gone by, it was the food of miners and farmers -- a robust parcel of pastry (so legend has it) that could be dropped steaming hot down a mine shaft to the menfolk below or thrown over a high hedge to the agricultural laborers on the other side.

According to folklore, in one end there was savory meat, spuds and turnip and -- on the other side of a pastry wall -- fruit jam.? Entree and dessert all in one steaming package.? Genius.

No wonder a simpler version was adopted all across the country.? It has become a staple of many a working lunch, snatched from the oven of a high street food store and wolfed down on the nearest bench or at a desk.

So into this culinary sanctum stumbled the British government.? Always anxious to raise more cash in these dark days of austerity, the Chancellor of the Exchequer George Osborne decided back in March to slap a 20 percent tax on hot snacks like pasties, pies and sausage rolls.

The plan was to raise an extra $150 million.

But Osborne -- a millionaire whose diet does not apparently include pasties -- had no idea that he was about to walk into a political furore that we have seldom seen since the 1990 Poll Tax riots.?

"Half-baked," screamed the tabloids.? "Save our pasties," the nation echoed as people licked their lips and bared their teeth.

A newspaper hired an actress dressed as Marie Antoinette to pursue the hapless Chancellor -- a reminder of her infamous quote that led to revolution across the Channel: "Let them (the poor) eat cake."

The accident-prone Conservative-led government had walked into a minefield of meat and potato proportions. Politicians rushed to have their photos taken stuffing pasties down their throats.

Even Prime Minister David Cameron was wrong-footed when asked in Parliament when HE had last eaten a pasty.? He claimed to have done so at a shop that closed down some years ago. Ouch!

So yesterday Cameron and Osborne decided on a change of diet: humble pie.

The Sun's front page story on the British government's 'pastygate' climbdown on Tuesday.

In a humiliating climb-down, the government was forced to abandon its snack tax.

Well, almost.? In a wonderfully British muddle, pasties will avoid tax if they are hot but cooling down out of the oven.? If the shop keeps them hot -- that will be another 20 percent please.

No matter.? Today's papers speak for the nation in declaring victory, with the mass market Sun saying it best: "Pasty la vista, taxman."

Peace has broken out in Britain's leafy suburbs and town centers.?One joyous Cornish Member of Parliament said there'd be "dancing in the streets."

But the message to our politicians is clear.

There is, after all, a line you cannot cross.? Our trains may not run when it rains or snows; you may not get through airport passport controls for hours; but mess with our favourite foods and we WILL bite back.

We are back from California, and very sad about it! Our trip was amaaaaaaaaazing.? We flew out on Wednesday night and came back last night? so it wasn?t very long, but we had so much fun!? We got to see all sorts of family and friends, went to the beach many times, did some touristy sight-seeing stuff, got good food (!), and yes- had our baby shower! The whole time we were surrounded by various family and friends and it was good (for me) to be around so many old familiar faces.? My mom kept rubbing my belly all week long sayign ?hi baby!? or ?how?s baby doing?!? all excitedly? it was weird to be constantly touched but we think she?s just a little bit excited about this new grandchild she?s getting. :)

The baby shower was completely amazing and totally deserves its own paragraph.? My mom hosted it for us at her house and all the little decorations and such were so cute!? She really put a lot of work into the shower- we felt very loved.? Lots of family and friends showed up and we played silly games like diaper change relay race and had each person make a scrapbook page for the baby that we can add photos to later.? We also went ahead and told everyone the name, since I had slipped so many times already that my mom already knew it!? Everyone except my dad liked the name, but he?s hard to please anyways. :) ? We got a toooonnnnn of gifts, most of which were clothes? We are officially done buying this baby any clothes in sizes 0-6 months, maybe even on up to 9 months! LOL.? We also got a bunch of gift cards to the stores we?re registered at, which will come in helpful, and a few homemade blankets/quilts for the baby that made me tear up when I saw them.? They were just so lovely and so much time and love were put into them by their creators!? Sniff, sniff.? Anyways, the biggest gift we got was the gift of our stroller, given to us by my grandma and aunt. That was unexpected and very very nice of them!? With that out of the way, the only big things we have left to get are our pack n play and my breast pump (which is where those gift cards will come in handy).? So overall our family and friends were very generous and I feel very lucky to have them!

Private profit for public good? Can investing in private companies ...

Donor governments and multilateral institutions have provided grants and loans to private companies operating in developing countries for decades. However, since the 1990s the scale of this support has increased dramatically. In 2010 external investments to the private sector by IFIs exceeded $40 billion. By 2015, the amount flowing to the private sector is expected to exceed $100 billion ? making up almost one third of external public finance to developing countries. As global ODA stagnates, several aid agencies have suggested a dramatic scaling up of public finance devoted to supporting private sector investments.

Using ODA for private sector investment is contentious among civil society organisations. Public development finance can play crucial roles. However, it is fundamental that public finance is channelled to the companies and sectors that have least access to private capital markets, hence ensuring that scarce public resources are genuinely additional to private finance. They must also be channelled to firms and sectors that can deliver the best outcomes for the poor, thus ensuring that public development monies are used for intended purposes.

This report assesses whether external (non-domestic) public finance for private investments in the South lives up to promises to provide finance to credit-constrained companies in developing countries and to deliver positive development outcomes. More precisely, it looks into how much development finance goes to the private sector, as opposed to the public sector; which institutions deliver this type of finance and how; which types of companies are benefiting the most from public support; and how development institutions ensure they support responsible investments that contribute to equitable and sustainable development.

For this purpose, Eurodad assessed recent grant and loan trends, and the portfolios of some of the largest multilateral and bilateral development agencies providing public support to private investments in developing countries. Eurodad?s sample included the World Bank International Finance Corporation (IFC), external lending of the European Investment Bank (EIB) through its African, Caribbean and Pacific countries (ACP) investment facility and Africa Infrastructure Trust Fund, and six bilateral DFIs from Denmark, Belgium, the Netherlands, Norway, Spain, and Sweden.

USF softball headed to Women's College World Series

The University of South Florida softball team needed one more out for history on Saturday night. In the stands, fans were tense. That's when USF coach Ken Eriksen visited left-hander Sara Nevins on the mound.

Some poker-faced players wondered: Why? Why now?

"I told them, 'I want to get some more TV time,' " Eriksen said, smiling. "Then I said, 'OK, Sara, jam her and let's 'Feed the Mouse.' "

Sure enough, Hofstra's Olivia Galati slammed Nevins' inside offering to the redoubtable Jessica Mouse at third base. Mouse's throw across the diamond was squeezed by first baseman Stephanie Medina.

And then ? bedlam.

As the emotions poured out, capping one of the seminal moments in USF athletics history, the Bulls had completed their Saturday sweep with a 2-1 victory against Hofstra in the decisive Game 3 of the NCAA tournament Super Regional before 1,544 fans at the USF Softball Stadium.

The Bulls (50-12) will open with No. 4-seeded Oklahoma in the Women's College World Series, which begins on Thursday in Oklahoma City. USF has not won a national championship in any Division I sport.

"I had nothing but confidence when the ball was hit to Jess," Medina said.

"You focus on making the play then ? tears of happiness, I would say," Mouse said.

When the celebration had died down, Eriksen and USF players expressed deep respect for Hofstra (42-15) and Galati, who threw all 27 innings and 328 pitches of the Super Regional.

"They played hard and so did we," Medina said. "It was a great series."

Each game was 2-1.

Hofstra won Friday night's opener in 11 innings with Galati winning her 32nd consecutive start to pull within one of an NCAA record that was established in 1982. Eriksen said his team wasn't about to panic. They just needed to play better on Saturday.

And the Bulls did just that, handing Galati consecutive losses.

USF, designated the visiting team in both games Saturday, faced elimination in Game 2, but prevailed in nine innings. Kenshyra Jackson's one-out RBI single in the top of the ninth drove home the first run, then Laura Fountain provided some insurance on a sacrifice fly.

It was needed.

The Pride loaded the bases with two outs and Becca Bigler beat out a slow roller and throw from USF shortstop Kourtney Salvarola, scoring Hofstra's run. Galati's subsequent grounder was scooped by Salvarola, who beat her by a step, preventing the tying run from scoring and ending the game.

In the decisive game, USF opened the scoring on Jackson's bases-loaded walk in the first inning. Medina provided the lead run with her sacrifice fly in the fifth. Leadoff batter Gina Kafalas set it up with excellent base-running. She singled, advanced on Mouse's sacrifice bunt and scooted to third on Galati's wild pitch.

"I think everybody did something to contribute to this ? including the so-called 'unsung heroes' ? and that's characteristic of this team," Eriksen said. "I knew what they could do. I've been around them all season. I felt good about this if we just executed."

USF received excellent pitching from Nevins, the left-hander, and Lindsey Richardson, the right-hander, who alternated throughout the series. Nevins had 23 strikeouts in 18 innings during the series, when she threw 305 pitches.

"Without our defense, none of this could have happened," Nevins said.

Nevins had her pick of schools coming out of Pinellas Park High. She wanted to stay home. And she was attracted by the notion of helping USF to its first College World Series.

Now it's reality.

Now it's history.

Before going to softball's Big Dance, USF players treated the crowd to some perfectly timed dance steps of their own. They were grinning, laughing, having fun.

"I don't think you can be too serious when you play this game," Eriksen said. "You prepare, but you play loose and confident. That's what this bunch has done. We won in the locker room long before this and that's what makes it so satisfying."

Golden Gate Bridge celebrates 75th birthday

Crowds gathered along San Francisco's waterfront Sunday, while San Francisco Bay was crowded with pleasure boats, tug boats and other vessels as the city celebrated the 75th anniversary of the Golden Gate Bridge.

Tens of thousands of people were expected to flock to the area to enjoy a number of events taking place along a section of waterfront stretching from Fort Point south of the bridge to Pier 39 along The Embarcadero.

At least several thousand people had gathered along the waterfront by Sunday afternoon, said Mary Currie, public affairs director for the Golden Gate Bridge, Highway and Transportation District.

"Everyone is biking and walking and looks very happy," she said. "We're off to a great start."

San Francisco resident Daniel Sutphin and his family were among those in the crowd enjoying the day and the views of the bridge.

"It's such an iconic structure, depending on the day or the hour, it just looks like it changes continuously," Sutphin said as he walked through the Fort Point area with his wife and their three young children.

Since it opened in 1937, more than 2 billion vehicles have crossed the 1.7-mile-long bridge named after the Golden Gate Strait, the entrance of water to San Francisco Bay from the Pacific Ocean, and championed by engineer Joseph Strauss in the 1920s.

Because of the crowds expected and with no parking available near the bridge, officials were urging people to take mass transit to the events.

The California Highway Patrol was planning on shutting down traffic across the bridge from 9 p.m. through 10 p.m. for a monumental fireworks display set to take place over the bridge.

In a stark contrast to the thousands of celebrants, members of the group the Bridge Rail Foundation, an organization dedicated to stopping suicide jumps from the bridge, erected a display of 1,558 pairs of shoes, representing the number of people who died in leaps form the bridge since it opened in 1937.

"It's a symbol of how deep and serious this problem has been," said Paul Muller, a spokesman for the group. "We're still losing 30 to 35 a people a year off the bridge," he said.

Meanwhile on the water, Golden Gate ferries were running again after a one-day strike disrupted service across San Francisco Bay on Saturday.

Workers represented by the Inlandboatmen's Union walked off the job on a day strike, forcing the cancellation of ferries operated by Golden Gate between Larkspur, Sausalito and San Francisco.

The strike was called after nearly a year of negotiations over workloads and other matters, said Marina Secchitano, the union's regional director.

California Gov. Jerry Brown issued a statement Saturday evening, saying that he was appointing a board to investigate the strike, which, he claimed, created a disruption to public service.

Secchitano disputed the governor's claim, questioning the motivation to call for an investigation after a one-day strike. "(This is) an action to try to silence us," she said.

"They're counting on this process to back our membership off the issue," she said.

Ferry and union officials said service resumed Sunday when workers returned to work.

NEW YORK (AP) ' One playoff victory was good enough for Mike Woodson to return as New York Knicks coach ' even with Phil Jackson lurking as a potential candidate.

Woodson knows more will be asked of him now.

"I know expectations are high and they should be high," Woodson said during a conference call, "and I'm looking forward to the challenge."



The Knicks removed the interim tag Friday and announced they had given Woodson a multiyear contract extension, rewarding him for a terrific finish to what had been a turbulent season.

Woodson led the Knicks to an 18-6 record after replacing Mike D'Antoni on March 14. The Knicks lost 4-1 to Miami in the first round, snapping an NBA-record, 13-game postseason losing streak by winning Game 4 for their first victory since 2001.

Still, there was speculation that Madison Square Garden chairman James Dolan would open one of the league's biggest check books to go after Jackson, the 11-time champion coach and former Knicks player who sat out last season after retiring from the Los Angeles Lakers.

Yet the Knicks never looked anywhere beyond Woodson, believing they can continue to improve with a full season of his coaching.

"I think Woody earned the right to be the first person we talked to and turned out to be the only person we talked to because our discussions with him after the season really reflected why he was so successful during the season," general manager Glen Grunwald said.

"We thought he was the right guy for this team at this time. Obviously, there's some great coaches out there that had we opened up the search would have been called, mainly Phil Jackson, who's the most successful coach in the NBA history, but we felt Woody was our guy and he showed it during the season and our discussions after the season."

Woodson shrugged off the Jackson speculation.

"Tremendous coach, I know his name's been mentioned a lot, but that was not my concern," Woodson said. "My concern at the time was coaching the New York Knicks the period that I had to coach and Mr. Dolan decided to bring me back."

Neither the Knicks nor Woodson would disclose the terms of the deal.

A first-round draft pick of the Knicks in 1980, Woodson returned to the team last summer as an assistant coach, providing a defensive-minded voice to D'Antoni's staff. Woodson's influence, combined with Defensive Player of the Year Tyson Chandler, moved the Knicks into the top half of the league's defensive rankings after they had been one the worst teams for years.

D'Antoni resigned March 14 when the Knicks were 18-24 and in danger of missing the playoffs. Woodson won his first five games and was praised by players for holding them more accountable to playing defense. Most importantly, he got the most out of Carmelo Anthony, who was having a disappointing season in D'Antoni's offense but was April's Eastern Conference player of the month.

"Mike took over the team under challenging circumstances and made it clear, starting on day one, that he was going to hold every player on our roster accountable," Dolan said in a statement. "We saw a significant improvement since Mike took over and believe our team will only keep improving under Mike's direction."

Woodson denied recent reports that he had replaced agent Joe Glass under pressure from Dolan to avoid having to work again with former coach Larry Brown's representation. Woodson confirmed he switched to CAA, but said it was his choice, and that agent Terry Prince had worked on his contract.

Anthony, Chandler and fellow star Amare Stoudemire had all backed Woodson's return when the season ended. And his chances of improving returned when the Knicks removed the interim tag from Grunwald, his former college teammate at Indiana, late in the regular season.

Woodson previously spent six seasons as coach of the Atlanta Hawks, improving his win total in every season until they went 53-29 in 2009-10. But he wasn't retained after they were swept in the conference semifinals for the second straight year.

He then sat out a year before interviewing last summer for openings in Detroit ' where he was an assistant on the Pistons' NBA championship team in 2004 ' Minnesota and Houston. He then was hired by the Knicks on Aug. 29.

Woodson has a career 224-292 record as an NBA coach.

When Will We, America?s Debt Slaves, Demand Liberty Be Given A Chance?

I know that some people like to believe that we have had periods of liberty over the past few decades in between hard-core leftist Presidents named Jimmy Carter, Bill Clinton, Barack Obama and even as far back as Woodrow Wilson and FDR.?But the fact is that even under Presidents such as Ronald Reagan and George W. Bush, America has still suffered from socialism.

Have we given the various flavors of liberalism enough chances to destroy America yet??We have entrenched big S Socialism into our society over the past century so that we know little else.?I understand that.?We have even dabbled with the various cousins small s socialism too such as Communism, Marxism, etc.?And where has it gotten us??How many trillions of dollars in debt for how many broken promises have these foolish endeavors heaped upon both our children and us?

?

Well, in case you don?t know, it is fast approaching $16 trillion.?That is in excess of the entire Gross Domestic Product of the United States for a whole year.?Meaning what??Well, meaning that if the federal government confiscated every ounce of productivity for 2012 it would just not be able to pay off the debts liberals have brought upon us.?Liberalism has turned generations of Americans into debt slaves controlled by Washington and who each have a personal share of the load hovering around $50,000 for every man, woman and child.?Got the money to pay up??Probably not.?The worst part is that the some Americans seem content to keep on selling their own children and grandchildren deeper into debt so that they can pretend that they are getting what the ghosts of liberals past promised.

Bush presided over TARP and the bailout of the banks among many other things that leftists would have had orgasms over had they been in charge of the White House at the time.?Yes, he was smart enough to see the mortgage crisis coming and it was hard-core leftists like Rep. Barney Frank (D ? MA ) that stood in the way of reform.?I know that.?But when the collapse came, Bush?s response to the failure of socialism was more socialism.

?

Oh yeah, and as much as President Obama and his cronies are trying to pin all that spending on President Bush, let us all recall that then Senator Obama supported and voted for TARP.?It is as much his mess as anyone's despite the fallacious claims that Obama is somehow such a fiscal hawk.

No, America has not had liberty for quite some time.?And, yes, honestly, when we did have it, we did stupid things with it.?You know, like that whole enslave the inferior black man tripe that liberals of their own day tried to pass off as just.?Again however it was liberals that were the problem, not liberty.?It was liberals who bastardized the meaning of liberty to freedom for whites and not for blacks.

So maybe it is just time that we go back to liberty.?You know, real liberty??Pure liberty??Personal freedom??Equal protection under the law??Limited government??The right to what one has earned by the sweat of their own brow and not what has been confiscated at the point of a gun??Huh??Maybe??What do you say?

Since 2008 there have been three major discussion papers examining the state of the Province?s legal clinics, the latest released in May 2012 with the intimidating title of ?Ideas for the Future Development of Clinic Law Delivery Services in Ontario?. This one is the most critical of the system yet, and announces its purpose is to challenge clinics to ?address fundamental questions about long term structure and sustainability of clinic law services in Ontario?.

With a background that includes taking part in the formation of the Northumberland Community Legal Clinic based in Cobourg, and many years of employment there as a community legal worker, this writer admits upfront that legal clinics are dear to my heart. While criminal and family law matters eat up the lion?s share of legal aid funding and use private bar lawyers to assist clients, the clinics, that part of Legal Aid Ontario that deals with poverty law specifically, are unique in how they practice the fine art of securing social and economic justice for clients.

Legal clinic help the poorest of the poor. These people are recipients of welfare, the provincial and federal disability programs, worker?s compensation, and employment insurance. They are almost all tenants and those not on public programs are likely to be among the working poor. They are the elderly on their skimpy old-age pensions or students trying to get through school without much help.

Besides their poverty, the other link that connects them is their vulnerability. The network of seventy-seven legal clinics in Ontario is their salvation, often their only one, when disaster strikes. Services range from quick telephone advice in simple situations to protracted cases in more complex areas like Canada Pension and Worker?s Compensation, taking years to resolve. If clinics have the luxury of enough time to take on community development projects in addition to the endless casework, tenant and injured workers? groups are started along with anti-poverty organizations to fight back against unfair government policies. They?re a busy bunch at most legal clinics and their communities couldn?t do without them, even as those communities are largely unaware of the huge contributions that legal clinics provide to their disadvantaged residents.

Legal Aid Ontario is part of the Ministry of the Attorney General, and like all ministries, has lately been engaged in various efficiency seeking and cost cutting exercises. While the Crown Attorneys enjoy big wage hikes and expansion to bolster the prosecution side of the justice equation, defense lawyers and legal clinics, who represent the rights of the accused and the disadvantaged, are pressured to keep those expenses down.

Clinic lawyers and community legal workers, who represent the cheaper paralegal component of the system, are paid from a salary grid established many years ago. They are not paid on a case by case basis like the lawyers in the family and criminal law systems. While each clinic?s community-based board of directors receives funding for staff based on the grid, there is almost no wiggle room when it comes to how that cash is allocated. The top of the legal clinic grid is nowhere near the heights achieved by lawyers working for the Crown, sending the clear message that the Province is much more interested in prosecution than preserving rights.

Yet even as this disparity widens, the clinics haven?t done too badly through the years. In 1995, the full complement of 77 clinics was operating at a cost of $37 million. By the funding year 2010/11, that funding had grown to $70 million for the same number of clinics.

In the usual Toronto-centric way of doing things, there are 35 of the clinics in the city with 10 in the North, 17 in our area called Central East, and a further 15 in Southwestern Ontario. Thirteen of these clinics are specialized with mandates in specific areas of the law or serving specific client groups. Toronto has a full range of services.

The rest are general clinics that handle a grab-bag of poverty law services, from provincial matters like Ontario Works, Ontario Disability Support Program, housing law, Employment Standards, Worker?s Compensation, Criminal Injuries Board and Human Rights to federal matters like Canada Pension, Employment Insurance and Immigration. That?s a mighty tall order, and clinic staff are kept hopping staying current in all those areas of law to provide skillful representation to the clients depending on them.

The bean counters are not happy with the clinic system as it stands today, and in the next installment of this series we will look at the source of their displeasure and some suggestions for overhaul.

MOGADISHU ? African Union and Somali troops seized a town on the outskirts of Mogadishu on Friday from Islamist militants after three days of fighting, marking the biggest victory over al-Shabab since the pro-government forces took control of the capital last August.

A top United Nations official, meanwhile, announced that a presidential election in Somalia will be held on Aug. 20 ? with votes cast by lawmakers instead of by ordinary Somalis because of continued insecurity in the country.

Lt. Col. Paddy Ankunda, the spokesman for African Union forces, said the troops moved into Afgoye on Friday and that most of the town was under the coalition?s control.

More than 300,000 internally displaced Somalis live in and around Afgoye, located 30 kilometers (20 miles) north of Mogadishu. Thousands fled the area in overloaded vans and donkey carts the previous two days amid gunfire and explosions.

African Union ?and Somali troops are here now, and al-Shabab abandoned the town,? resident Aden Muse said by phone. ?The fighting has stopped and people are indoors. We hope no more fighting will happen.?

Soldiers have taken positions in the police and district headquarters, residents said.

?Tomorrow will be a new beginning for us,? said another resident, Ubah Salad.

The U.N. representative for Somalia, Augustine Mahiga, said Friday at a news conference in neighboring Kenya that the pro-government forces needed to capture Afgoye for military and humanitarian reasons. He said al-Shabab manufactured its bombs in Afgoye and that the town ?controls the exit and the entries to Mogadishu.

?And it has been the military concentration and headquarters of the Shabab. Hitting Afgoye would make a significant military breakthrough in the region of Mogadishu,? the U.N. official said.

The Afgoye corridor between Mogadishu and Afgoye is home to the largest concentration of internally displaced people in the world, Mahiga added. He said aid agencies plan to begin helping them.

The U.N. recently approved a near doubling of the African Union force to more than 17,00 troops. Mahiga cautioned that the new troops are deploying far from Mogadishu and that, with pro-government forces being stretched, insurgents could infiltrate back into areas that have already been seized near the capital.

The next Somali presidential election will take place on Aug. 20, Mahiga said. Votes will be cast by members of a new 225-member parliament. Voting isn?t being opened to the public because of a lack of security across the country.

In meetings this week in Ethiopia, Somali leaders worked toward adopting a new constitution and to end the transitional government?s tenure. The U.N. mandate that authorizes Somalia?s Transitional Federal Government expires on Aug. 20.

Somalia dissolved into anarchy in 1991 and has seen little government order since. The AU?s defeat of al-Shabab in Mogadishu is the first time the capital has been secure in years. The U.N. and international community is pushing Somali leaders to make an orderly transition to the next phase of self-government with the election of a smaller parliament and a new vote for president.

What Are These Necessary Skills?

According to legal experts: communication, the ability to analyze any given situation, and research are some of the major aspects of the job of an attorney. We can explore these individually to see just exactly what these experts are referring to. First let?s take a look at communication: if you are a lawyer working United States of America, English needs to be your number one language. Will it come in handy to know several of the languages that might be spoken in your community? Absolutely. Spanish is relatively popular; Hmong is becoming increasingly popular; German and Polish are probably runners up. Taking the analysis and research that you have worked on and putting it into terms others will understand and identify with is the major functionality of communication. You must make others not only identify with your client, but also empathetically (or sympathetically) put themselves in your client?s shoes.

The Importance Of Research And Analysis

Research serves as the basis for the other skills discussed here. Without the proper research adequate analysis cannot be executed. Without the proper analysis, good communication will not be achieved. Should your research skills be lacking you will not succeed as a good lawyer. As sort of a side note, software is important; inadequate software limits your research potential. Certain software is more utilitarian in a legal sense and reviews for such can be found online. Now it?s time to analyze; this is probably the most difficult part. You can look up everything you need to look up: the laws, the history, any cases that may apply to yours. You can talk your way into or out of almost anything in the world. But if you can?t analyze what you?ve researched and get the results of that analysis across to a judge or jury the other two skills are simply wasted.

Vocabulary is a big part of not only your communication skills but your research skills as well. Taking a course to increase your vocabulary should be considered an extremely effective self-improvement modus operandi (that?s legal speak for technique).

Indian passenger train rams freight train; 25 dead

HYDERABAD, India (AP) ? A passenger train rammed into a parked freight train and caught fire before dawn Tuesday in southern India, killing at least 25 people and injuring dozens more.

Rescuers worked for about six hours to pull some 70 survivors from the twisted and smoldering wreckage near the southwestern border of Andhra Pradesh state.

Medical workers brought drinking water to traumatized survivors at the scene, while mothers cried for help in finding their lost children. Witnesses reported seeing victims on fire.

"When the train stopped with a loud bang, I got down to see burning passengers crying for help," Munijayendra, a 25-year-old marketing executive who goes by one name, told Press Trust of India. "The worst part is we were helpless, as the heat was just unbearable."

At least 40 people were hospitalized with injuries, with about 10 in critical condition, local police chief Charu Sinha said.

The driver of the Hampi Express, upon seeing the cargo train stopped on the tracks ahead, slammed on the emergency brakes, which caused four cars of the Express to derail, officials said.

The first passenger car caught fire, burning to death 16 people who were inside, Sinha said.

"We are trying to identify the bodies and will hand them over to the families," district official Durga Das said.

Firefighters and police put out the flames within three hours. Railway Minister Mukul Roy ordered an investigation, while officials said they were looking into whether the driver may have missed a signal or if the signal had malfunctioned.

"It seems that the driver of the Hampi Express overshot the signal," railway spokesman Anil Saxena said in Delhi. The driver and his assistant were among those hospitalized and had not yet been questioned by authorities.

Some of the victims were women and children, though most were construction workers traveling from the towns of Bellary and Hospet in the neighboring state of Karnataka to that state's capital of Bangalore, police official Harinath Reddy said. The route of the Hampi Express crosses back and forth between Andhra Pradesh and Karnataka.

The collision took place at a station near Penukonda, about 170 kilometers (105 miles) north of Bangalore.

Karnataka's chief minister, Sadananda Gowda, said relatives of the victims would be given 100,000 rupees ($1,800) in compensation.

Railway accidents are common in India, which has one of the world's largest networks and serves some 20 million passengers a day. Most collisions are blamed on poor maintenance and human error.

In March, a train plowed into an overcrowded minivan on its tracks and killed 15 people in the minivan in the northern state of Uttar Pradesh.

A month earlier, a train derailed after hitting a bulldozer in the northeast state of Assam, killing three train passengers and injuring 16.

A collision in January between a passenger train and a freight train in northern Jharkhand state killed five people and injured nine.

Researchers have uncovered what makes one particular strain of methicillin-resistant Staphylococcus aureus (MRSA) so proficient at picking up resistance genes, such as the one that makes it resistant to vancomycin, the last line of defense for hospital-acquired infections. They report their findings in mBio, the online open-access journal of the American Society for Microbiology, on Tuesday May 22.

"MRSA strains are leading causes of hospital-acquired infections in the United States, and clonal cluster 5 (CC5) is the predominant lineage responsible for these infections. Since 2002, there have been 12 cases of vancomycin-resistant S. aureus (VRSA) infection in the United Statesall CC5 strains," write the researchers from Harvard, the Massachusetts Eye and Ear Infirmary in Boston and the Broad Institute in Cambridge and other institutions. "Vancomycin is a key last-line bactericidal drug for treating these infections."

The CC5 strain of MRSA has managed to acquire resistance to vancomycin on 12 separate occasions, and although it hasn't spread widely yet, the risk that MRSA could eventually overwhelm even our last-line drugs is a very serious one. In the study, the researchers sequenced the genomes of all available vancomycin-resistant MRSA strains to find what distinguishes them from other lineages and why CC5 is apparently more adept than other strains at picking up vancomycin resistance.

They report that vancomycin-resistant MRSA strains and other CC5 lineages have some important differences from other types of MRSA, including adaptations that allow them to co-exist with other types of bacteria and may help them take up foreign DNA. They all lack the operon called bsa, for instance, a set of genes that encode a lantibiotic bacteriocin, an antibiotic protein made by bacteria to kill other bacteria. This is important, say the authors, because it enables CC5 to get along well with other bacteria in mixed infections. Instead of killing off competing organisms, CC5 aims to co-exist. This enables it to pick up genes - like the one that encodes vancomycin resistance - from unexpected places. Mixed infections are breeding grounds for antibiotic resistance because they encourage the exchange of genes among very different kinds of organisms.

In roughly the place where these bacteriocin genes are missing is a unique cluster of genes that encode enterotoxins, proteins that attack the human host and, again, could make it easier for mixed populations of bacteria to grow at infection sites.

Finally, CC5 has a mutation in a gene called dprA, which is known to influence the ability to assimilate foreign DNA. The mutation could alter or eliminate the function of dprA in CC5 strains of MRSA, making it amenable to taking up DNA from outside sources.

The sum of all these traits, including the lack of bacteriocin production, the ability to produce enterotoxins, and mutations in the ability to assimilate foreign DNA, is a lineage of S. aureus that is optimized to grow in exactly the types of multi-species infections where gene transfer could occur.

This makes CC5 a dangerous organism in hospitals, say the authors. In hospitals, pathogens are under continuous pressure from antibiotics to survive and evolve, and CC5 isolates appear to be very well adapted to succeed by acquiring new resistances. Frequent use of antibiotics in hospital patients could select for strains like CC5 that have an enhanced ability to co-exist with bacteria that provide genes for antibiotic resistance.
